Notwithstanding the significant increase in the growth of franchising in Australia across many sectors over the past ten (10) years, this also has seen circumstances arise where it has been necessary for the relationship with the Franchisee to be brought to an end. This can be due to many factors including:
- The Franchisee is operating outside of the terms of the Franchise Agreement regarding product offerings or the purchase of supplies.
- They are non-compliant with other terms in the Agreement, such as reporting of information etc.
- The Franchisee may be insolvent or likely to become insolvent. This can be particularly relevant where the Franchisor may be a secured creditor.
The Partners have been appointed external administrators to a significant number of franchises across a broad sprectrum of sectors. The areas in which we can assist Franchisors are:
- Investigating accounting reports, particularly in circumstances where there have been issues with fraud or other actions which have caused loss to the Franchisor
- Acting as Receivers and Managers, Agent for the Mortgagee in Possession, Court Appointed Receivers/Liquidators and Voluntary Administrator.
